BACKGROUND


The Chain of Responsibility (CoR) aims to ensure that every party involved in the supply chain shares both equal and joint responsibility for the safe execution of transport activities. Its purpose is to prevent breaches of the Heavy Vehicle National Law (HVNL), whether those breaches occur through direct actions or omissions. Under CoR legislation, any individual or entity that exercises, or has the ability to exercise, direct or indirect control or influence over any transport activity is considered part of the CoR. This inclusion means that all such parties have a duty to guarantee safety and maintain compliance with the HVNL.


Furthermore, CoR laws extend accountability to corporate entities, boards, directors, partners, and managers for the actions and inactions of the businesses and individuals under their control. This collective responsibility is what defines the Chain of Responsibility within the HVNL framework.


Another key objective of CoR is to prevent any party from gaining an unfair commercial advantage by operating outside the boundaries of relevant laws, such as by avoiding the time and cost required for proper compliance. The HVNL acknowledges that responsibility for offences committed along the supply chain may rest with multiple parties—not just heavy vehicle drivers and operators. In fact, an individual may have responsibilities in the chain in more than one capacity.

SCOPE OF WORKS



Develop the required Transport Safety Management System (TSMS) documentation for management of transport safety including Chain of Responsibility (CoR) provision under the Heavy Vehicle National Law (HVNL) which shall include the relevant Plans, Procedures, Policies and supporting forms and tools documentation required.


METHODOLOGY

Our methodology and approach will consist of the following:

Development of the Transport Safety Management System (TSMS) documentation

Develop the identified Transport Safety Management System (TSMS) documentation, adopting the company’s logo/format with the supporting forms, and tools which shall include:

HVNL / CoR Management Plan

The HVNL/CoR Management Plan provides overall guidance on the minimum requirements for management of transport safety including Chain of Responsibility (CoR) provision by the company and its Supply Chain Partners and defines the overall structure, policies, procedures on all Transport Safety Management operational management issues.


The HVNL Management Plan, or Chain of Responsibility (CoR) Management Plan, is a formal safety framework under the Heavy Vehicle National Law (HVNL) that details how a business identifies, manages, and mitigates risks across the entire heavy vehicle supply chain, ensuring everyone—drivers, operators, schedulers, consignors, loaders—meets legal safety duties for things like mass, dimension, fatigue, speed, and vehicle standards. It's a proactive risk management tool, not just a document, outlining processes, responsibilities, and controls to prevent breaches and harm.


Transport Safety Policy Statements

Essential Transport Safety Policy acts as a compass by providing direction and framework for establishing key corporate level performance measures and related improvement objectives and targets which may include:

  • Transport Safety Policy
  • Alcohol and Other Drugs Policy


Forms and Templates

To support your CoR policies and procedures, a suite of forms and templates are developed that are easily accessible to those required to complete them. As an example, a driver will access the vehicle pre-start check prior to starting their transport task and complete the form. By completing this form, they are confirming that they have completed the activity as required and it is safe to commence the transport activity.

To meet the current Tender or Contract requirements:


Independent Audit/Review Report

A detailed report shall be developed outlining the results of the evaluation, including highlights, notable observations, and pertinent recommendations, areas of improvement and corrective action.


Certificate

Zenergy shall issue a Certificate for the company as the Transport Safety Management System documentation provided has been assessed as meeting the requirements of Chain of Responsibility (CoR) provision under the Heavy Vehicle National Law (HVNL). Note: The Certificate is valid for 2 years and is also valid for other Contractors including CPB and John Holland as they will ask for the same on other projects.
