HVNL and Chain of Responsibility


Our approach towards transport safety is to support and ensure Chain of Responsibility (CoR) compliance for an organisation in all its transport activities, as they relate to safety and the obligations and responsibilities under the Heavy Vehicle National Law (HVNL)..

The aim of CoR is to make sure everyone in the supply chain shares equal and joint responsibility for ensuring transport activities are performed safely and breaches of the HVNL do not occur, whether by act or omission. Under CoR laws anybody that exercises (or has the capability of exercising) direct or indirect control or influence over any transport activity is part of the CoR and therefore, has a ‘duty’ to ensure safety is assured and the HVNL is complied with.



In addition, corporate entities, corporate boards, directors, partners and managers are also accountable for the actions and inactions of businesses and people under their control. This is the Chain of Responsibility (CoR).

The HVNL recognises multiple parties (and not just drivers and operators of heavy vehicles) may be responsible for offences committed along the supply chain. A person may be a party in the chain in more than one way. For example, they may have duties as the employer, the operator and the consignor of goods.

 

Under the HVNL, Transport Safety Management System and controls (such as safe work practices, training and procedures) should be in place to prevent breaches of the HVNL, manage risk and maintain a safe road environment.
